The Promoter is Berowra Waters Wholesale (ABN 23 125 956 505) of 975 Old Northern Road, Bringelly, NSW 2556 (BWW).

Participation in the promotion is deemed acceptance of these terms and conditions.

The promotion starts on 5 December 2016 at 00:01 (AEDT) and concludes on 31 December 2016 at 23:59 (AEST) (Promotion Period).

To be eligible to participate in the promotion, you must:

be an Australian resident aged 18 years or above;

be a purchaser or an immediate family member of a purchaser (spouse, de-facto, child or parent) who purchased and took delivery of a new Bayliner boat (Original Purchaser) from an authorised dealer between December 5 2016 and December 31 2016

Employees and immediate family members of BWW, its associated agencies and companies are not eligible to participate in the promotion. Fleet owners, government authorities and agencies are also excluded from participating in the promotion.

In order for the Eligible Customer to claim their AUD$1,000 (Customer Cash Back):

the Original Purchaser must be present (with relevant identification) at the time of purchase of the New Bayliner; and

following the purchase and registration of the New Bayliner, the Eligible Customer will have to fill in a form with the dealer who will send a copy of the contract of sale for the New Bayliner(Sale Agreement) or other evidence of purchase of the Bayliner as deemed acceptable in BWW’s sole discretion.

To be eligible for the Customer Cash Back, the Sale Agreement must be received by BWW before 23:59 (AEDT) on 6 January 2017.

The Customer Cash Back is limited to one Customer Cash Back per Original Purchaser.

Incomprehensible and illegible Sale Agreements, accompanying documents or other evidence of purchase will be deemed invalid and unacceptable.

BWW will not be responsible for any Sale Agreement that is lost during transmission or is illegible or damaged upon receipt by BWW.

Upon receipt of the Sale Agreement, BWW will verify the identity and eligibility of the Eligible Customer at the time of purchase and delivery of the New Bayliner boat.

BWW reserves its rights to accept, refuse or reclaim the Customer Cash Back if, at the time of processing or subsequently, BWW discovers that the eligibility of the customer at the time of purchase or delivery of the New Bayliner boat was not valid or legitimate.

BWW reserves the right to request Eligible Customers to provide proof of identity, delivery address and/or proof of the Sale Agreement being sent in order to claim the Customer Cash Back. Proof of identification considered suitable for verification is at the discretion of BWW. In the event that an Eligible Customer cannot provide suitable proof, the Eligible Customer will forfeit the Customer Cash Back in whole and no substitute will be offered.

Upon verification of the identity and eligibility of the Eligible Customer, a cheque to the value of AUD$1,000 will be sent to the Eligible Customer’s address, as stated in their online cash back application, within an eight (8) week period. The Eligible Customer is responsible for banking the cheque prior to its expiry, and BWW will not be responsible for any delays or the Eligible Customer’s inability to bank the cheque with a financial institution or prior to its expiry. BWW will not exchange the cheque for cash or any other payment method nor will it change the name on the cheque from the Eligible Customer’s name.

The promotion and the benefits of the promotion may not be combined with any other promotional offer run by BWW.

Any claim for the Customer Cash Back under this promotion will make the claimant ineligible to claim under any similar BWW promotion in relation to the New Bayliner boat.

BWW reserves the right to verify the validity of Sale Agreements, evidence of sale of Original Bayliner boats and identification of Eligible Customers, and to disqualify any Eligible Customer which, in the opinion of BWW, has tampered with the claiming process, submits a claim that is not in accordance with these terms and conditions or who has, in the opinion of BWW, engaged in conduct in entering into the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or BWW.

BWW is not responsible for any costs incurred by the Eligible Customer in participating in the promotion or an Eligible Customer’s inability to access the internet or email.

In the event that, for any reason whatsoever, an Eligible Customer does not take the Customer Cash Back at the time stipulated by BWW and as contained in these terms and conditions, then the Customer Cash Back will be forfeited.

The Customer Cash Back or the legal or beneficial interest in the Customer Cash Back cannot be transferred or assigned and cannot be redeemed for anything other than the cheque sent to the Eligible Customer.

Independent financial advice should be sought as to tax implications that may arise as a result of accepting the Customer Cash Back.

Should an Eligible Customer’s contact details change during the Promotion Period, it is the Eligible Customer’s responsibility to notify BWW. A request to access or modify any information provided in an entry should be directed to BWW.

In the case of the intervention of any outside act, agent or event which prevents or significantly hinders BWW’s ability to proceed with the promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, BWW may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions, subject to any written directions given under applicable laws.

If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of BWW, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, BWW reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and may take any action that to cancel, terminate, modify or suspend the promotion, subject to any applicable laws.

BWW is not responsible for any incorrect or inaccurate information, either caused by the Eligible Customer, or for any technical error, or any combination thereof, that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of Sale Agreements, and reserves the right to take any action that may be available.

BWW reserves the right in its sole discretion to disqualify any individual who BWW has reason to believe has breached any of these terms and conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. BWW’s legal rights to recover damages or other compensation from such an offender are reserved.

To the extent permitted by law, BWW may, in its discretion, provide the Customer Cash Back to customers who do not comply with these terms and conditions.
